Tim Gough

Tim brings a strategic and commercial approach to Family Law matters, and focusses on reaching the client’s desired outcome in the most efficient, tax-sensitive, and cost-effective way possible. He is highly skilled in “cutting through the noise” and prioritising the most important aspects of a matter.

  • Biography

    Tim has practised exclusively in Family Law since 2008 and attained his Specialist Accreditation in Family Law in 2013.  He holds a Bachelor of Law and Bachelor of Computer Science from Monash University.

    Tim is an Accredited Specialist in Family Law and a member of the Law Council of Australia and the Law Institute of Victoria. Tim has also been recognised in Best Lawyers Australia since 2021 for his expertise in Family Law.

    He ran a volunteer legal clinic at Monash University for 14 years from 2009 to 2023.  Since then, he has been invited to deliver guest lectures to Monash students each semester on Family Law, Technology and the Law, and Practical Legal Training.

    Tim is also regularly invited to present to industry bodies and at CPD conferences on the technical intricacies of Financial Agreements, Child Support Agreements, and complex Family Law issues generally.

     

  • Expertise

    Tim has deep expertise in matters involving high net-worth and complex corporate and trust structures. He has run and resolved some of the largest dollar-value Family Law litigation in Australia. His commercial approach and experience in complex property matters means he is often engaged to advise third parties to a Family Law dispute, such as business partners or companies which co-own assets that are the subject of a Family Law claim.

    Tim is also a recognised expert in pre-nuptial Financial Agreements and complex Child Support Agreements. He is routinely engaged to draft or advise on complex Financial Agreements for large families seeking to protect inter-generational wealth from future Family law claims.

    Tim brings his friendly and pragmatic approach to parenting cases and is adept at navigating the complexities of those matters. He takes a particular interest in parenting matters which don’t fit the traditional “nuclear family” paradigm.

    Some significant cases Tim has been involved in include:

    Sandini Pty Ltd atf the Karratha Rigging Unit Trust & Ors v. Ellison & Ors v. Commissioner of Taxation of the Commonwealth of Australia & Ors [2018] FCAFC 44; HCA Trans 190, a landmark Full Federal Court tax decision regarding CGT rollover relief in Family Law matters.

    Halstron & Halstron [2022] FedCFamC1A 65, a Full Court decision in a complex Family Law matter involving multiple asset classes and trust structures.

    Marcos & Serina [2023] FedCFamC2F 1474, in which Tim successfully argued that there should be no adjustment of property after a lengthy de-facto relationship.
